NEWS

  • Raymond Lutz arrested!
    • Lutz arrested while engaging in the peaceful political activity of voter registration at Civic Center Plaza.
    • Video of this event now going viral as people cannot believe an arrest of someone just doing voter registration.
    • Lutz booked for trespassing. Hearing scheduled for Jan 10. $1,000 bail provided with no fee by Golden Boy bail bonds.
    • Press Conference in support of Lutz was planned for 7:30 pm on Tuesday, November 29th at Civic Center Plaza.
    • Owner/Operators of Civic Center Office Building include Goldman Sachs, hedge funds and Wall St. Banks -- a who's who of the criminal banking industry 0.1%
    • Ray Lutz has filed a lawsuit against the owners and operators of the Civic Center Plaza building, that invoked the citizens arrest.
      • Press conference held Nov 30 at 5pm to announce the lawsuit.
      • Attorney Michael Aguirre will handle the case on contingency basis, but we still will need to fund-raise for court costs and fees, for war chest and defense fund.
      • Fundraising will be set up shortly separate from OSD funds.
      • I daresay they will be very sorry they stepped over this line.
    • The ACLU is considering taking up a case to test Pruneyard for the case like what we have in San Diego: The public square where part of it is owned by a private party, and the fact that voters who were registering were not allowed to complete their registrations.
    • (I thank email blast team for getting most of this ready... I am too tired to do much this time around.)
    • Many other people set up registration tables to challenge the building to try more arrests.
  • Occupiers "re-occupied" the Civic Center Plaza at 5pm, Monday, November 28
    • As 5pm got closer, police presence increased. Down the street, the Sheriff's Dept had uncounted officers in riot gear.
    • 35 tents were carried into the Civic Center Plaza and erected as promised.
    • But they were miniature tents. Ha ha, the joke is on the police and their ridiculous reactions.
  • Hunger Strike -- John Kenney continues his hunger strike, now in day 23. He is requesting that the City come to the table and discuss the right of Occupy San Diego to conduct protests in the form of an encampment. John is now sick and I am starting to worry about his health.
    • Need to get a wheelchair for John at this point as he is feeling weak. Any donations?
  • Jury Trial for Randy Wolling, AKA "Sage" commenced with jury selection. This should be done by today and first evidence will be presented.
    • Sage was sitting on the sidewalk after the second raid. He is charged with impeding an officer, and illegal assembly.
    • He has been in jail since Oct 28, over a month due to two other previous charges outstanding: meditating on Blacks Beach and being on Blacks Beach before 6am.
    • I can't believe they are wasting their time and money on this. No wonder our government is low on money.
    • Final arguments to be presented on Dec 1. Be at courtroom at about 9:30am to support Sage. VERY IMPORTANT

[SDCPJ] Voting registration will resume 10 a.m. Wed. at Civic Center! Support Needed!

Via Occupy San Diego

IMPORTANT! Tomorrow morning (Wed.) at 10:00 AM we will be setting up another voter registration center at Freedom Square (SD Civic Center) to replace the one terminated by SDPD today when they arrested Ray Lutz for registering voters. The center will be staffed by OSD members. WE WILL REGISTER VOTERS. WE WILL HELP THE WORLD REMEMBER the California Supreme Court decision that protects speech and petitioning in "the public square" even if privately owned. If you want to be part of this peaceful action, if you want to register to vote, PLEASE we need you to attend! Tomorrow (Wednesday) starting at 10:00AM.

The policeman arresting him said he was being charged with trespassing and refusing to leave. More info when it's known. Calling all cyclists. Tomorrow, tuesday night at nine o'clock pm at the Civic Center we are having our fourth ride and meeting of Occupy Riders. For those of you that do not know we are building a bike cavalry arm of OSD. This affinity group will be a highly mobile protest platform and scouting unit for the Occupation. Check out our Facebook page Occupy San Diego Riders group. Since we engage in direct action protests and operate moving vehicles simultaneously we have agreed to a code of conduct (posted on our FB page)for our safety and longevity. If you can agree to these simple guidelines you are more than welcome to ride with us. These rides have been amazingly fun and inspirational so DONT MISS IT!!!

THANKSGIVING not too happy thanks to early morning raid by SDPD, arresting three individuals.
Early this morning, Thanksgiving Day, the San Diego Police arrested three individuals around 2 AM. The first, a disabled man who uses a wheelchair, was arrested for "indecent exposure" after urinating in a bottle. The second two for sleeping in public. Essentially, all three were arrested for the crime of being poor and homeless. But as has become clear, this is selective enforcement. Throughout the city of San Diego, these "crimes" are committed. However, they are only enforced in the Civic Center Plaza. They are only enforced where the homeless have become politically active, as part of the nationwide Occupy Wall Street movement. This has become abundantly clear to me as I have regularly spent time at the Civic Center Plaza since the original Occupation on October 8th. It is truly shameful that Mayor Jerry Sanders is directing this, that Police Chief Lansdowne allows his police force to be misused for political repression, and our City Council stands by passively and allows it to continue.
  • This was a heartless and despicable act by the SDPD on Thanksgiving morning. I believe they use these arbitrary arrests in a little game the police are trying to play called, "you do what we want, and we won't engage in arbitrary arrests." Frankly, the concept that the police can just arbitrarily arrest someone for the "crime" of sleeping, must be stopped. Sleeping is not a crime.

  • Lori Saldana, former state Assembly member (and candidate for Congress) has announced that she will work with us to get an investigation and hearing by state officials (hopefully) here in San Diego regarding the rampant abuse and infringement of our constitutional rights, as described above. Intense scrutiny has been given to actions at UC Davis, but the despicable actions of the SDPD far exceed anything done there, but so far has been given the blind eye by officials.
    • Ray Lutz will be setting up a new petition to gather signatures in support of the hearings.
    • Suggest that a press release calling for the investigation and hearing, linking to the petition and detailing many of the abuses, should go out on Monday.

Despite what you might hear on the corporate-owned news:

  • The occupation continues, around the clock.
  • PLEASE COME DOWN when you can and help with numbers. This is your true vote. Stay at home = vote against 99%.
  • Tents and almost everything is now being restricted by the police.
  • Food is needed -- we no longer have a food table, so you'll have to play it by ear.
  • We will not be denied our constitutional right to assemble and speak!
  • Many Teach-ins on Sunday!

Black Friday or Buy Nothing Day?
And then what?

The day after Thanksgiving in the US is called Black Friday because it is supposedly a day where so much shopping happens that stores get out of the "red" (negative) for the year. BUT it's also a day of mass consumerism, crazy-making and violence. Yes, literal craziness to the extent that people even DIE from stampedes of shoppers -- just check out the online search https://duckduckgo.com/?q=black+friday+deaths

Okay, maybe money is tight and your washing machine broke and you can only afford one on deep discount, if at all... Or, you want to do your part to shop consciously for discounted Organic Fair Trade coffee or such... I get it. The economy does suck for "99%" of us, in different ways depending on your class, race, community, etc. Let alone the rest of the world.

BUT, I'm not talking about just one day. This is about changing a system. A protest that lasts one day is a symbol, like Thanksgiving, of something else more meaningful and is certainly useful. But what do we do *after* that day? If you wonder what that "more" meaning is or what you can do, consider celebrating the season in a different style...

On the Monday before Thanksgiving, multi-faith leaders from San Diego County will hold a short service of peace, nonviolence, gratitude, thanks and sharing. As a community of Occupy supporters and friends we are all invited to bring pies of all sorts, (chicken, turkey, tofu, pumpkin, peach, apple) to share together in thanks and gratitude for those holding the space at our local Occupation and to give thanks for all those lifting up the issues of fairness, compassion and equality being shared by this movement.   • Note about Alert sent today: The alert sent to email blast list was sent at about noon. Many people were checking their email later, came down to the Civic Center Plaza at maybe 6pm and wondered what all the hoopla was about. The request for the email blast came from the Celly text list (see details below to subscribe.) To make sure we avoid false alarms, our procedure will be to check with at least two other people on the ground. Also, the time should have been in the email to make sure you know when it was sent. This will be corrected in the future!

  • Police are trying to beat us down at the Civic Center Plaza. The following from a post on Facebook:
If you stand under the overhang at the west end of the plaza, they are calling that loitering. We were told when beginning the first teach in/workshop, where we'd always held it when it was raining or threatened to rain, that we were subject to arrest for loitering if we did not move then on order - and that we were subject to immediate arrest for the next 48 hours after the warning if we returned anywhere under the overhang. Furthermore, they will apply that to any occupier. It follows a pattern of increasing harassment and intimidation of the weekend teach ins, that is always paralleled with increased harassment of the 24-7 occupiers. Today they were also harassed for 'loitering' in the earlier morning hours for escaping the rain a little while under the overhang, and then for using umbrellas which were dubbed by the police as 'structures being erected'. The one arrest this morning was among the 24-7 occupiers who had been talking to the police about their new umbrella rule. It occurred exactly as the first teach in/workshop began, which is also a pattern. It is petty intimidation, and we will not back down.

It turns out that the law that is quoted on the sign has an exemption for peaceful political activities. Anyone who takes part in any future teach-ins should print out the information below and show to the police:

§52.80.01 Trespasses upon Privately Operated Business Premises Prohibited

(a) No person shall have the right to use privately operated business premises which are open to the general public for any purpose which is contrary to the functions or services provided thereon without the consent of the owner, operator or agent thereof. It shall be unlawful for any person so using such property to refuse or fail to leave such property upon being requested to leave by the owner, operator or agent thereof.

(b) It shall be unlawful for any person without the permission of the owner, operator or agent of privately operated business premises which are open to the general public to enter upon such premises within forty–eight (48) hours after having been requested by the owner, operator or agent thereof to leave therefrom pursuant to the provisions of subdivision (a).

(c) Exceptions. The provisions of this section shall not apply in any of the following instances:

(1) Where their application results in or is coupled with an act prohibited by the Unruh Civil Rights Act or any other provisions of law relating to prohibited discrimination against any person on account of color, race, religion, sex, creed, ancestry or national origin;

(2) Where their application would result in an interference with or inhibition of peaceful picketing directed toward the business establishment, lawful labor activities, or peaceful political activities;

(3) Where their application results in or is coupled with an act prohibited by Section 365 of the California Penal Code or any other provision of law relating to duties of innkeepers and common carriers;

(4) Where the person who is upon the privately operated business premises which are open to the general public is present under claim or color of legal right. This exception is applicable to situations wherein public officials are present in the course of their official duties and to situations involving disputes wherein the participants have available to them practical and effective civil remedies such as: marital and post–marital disputes; child custody or visitations disputes; disputes regarding title to or rights in legal property; landlord–tenant disputes; disputes between members of the same family or between persons residing upon the property concerned up until the time of the dispute; business–type disputes such as those between partners; debtor–creditor disputes; and instances wherein the person claims a right to be present pursuant to order, decree or process of a court.

  • 14 Dec 2011 - (7p) -- Occupy SD benefit concert featuring Liquid Blue and other music and speakers at The Ruby Room, 1271 University Ave, San Diego, CA 92103
    • $5 cover charge. ALL proceeds go to OSD.
    • This is a chance for everyone to support the movement. Invite your friends and others who might not be in a position to "occupy" on a regular basis but believe in the cause. All music will be socially conscious. Featuring originals as well as classic protest songs from the likes of Dylan, Springsteen, Lennon, Green Day and more.
    • About Liquid Blue - The world's most traveled band has performed in 115 countries. Their recent Top-10 Billboard dance hit, Earth Passport is a song about world peace and features vocals in nine languages. The band is the first and only "certified green" act in San Diego and have a long history of activism.
