Last week, the House of not always so Representative(s) voted for the misnamed American Security Against Foreign Enemies (SAFE) Act, aka the stiff the Syrian and Iraqi refugees bill to put more hurdles in the way of desperate people fleeing wars and carnage for which the U.S. bears much responsibility. Forty-seven Democrats joined all but two Republicans in supporting this fear-mongering wrong-headed reaction to the recent tragic attacks in Paris. The vote in the House is right on the cusp of the 2/3 majority needed to override a promised presidential veto. We can't let the Senate make the same mistake. While Senate Minority Leader Harry Reid says he will keep a similar bill from even being voted on in the Senate, we need to raise our voices, especially as the issue could be attached to a must-pass Omnibus spending bill in a few weeks, even if the Senate doesn't vote on the anti-refugee bill. Please make two calls to your Senators today. You can reach their Washington, DC offices via the Congressional switchboard at 844-735-1362.  As Congress is in recess for the Thanksgiving holiday, you may have better luck calling their home offices. Dear Friends,

The long-awaited hearing on our appeal of the October 2014 trial court ruling in the Che Café unlawful detainer (eviction) lawsuit is upon us.

 

November 18, 2015

2:30 pm

Appellate Division of the Superior Court, 220 West Broadway, San Diego, CA.

 

It's in the presiding department on 2nd floor. It's a big room by the elevators.

 

It will be before a three judge panel.

 

 

 

Although we negotiated a "suspension" of eviction enforcement action with the UCSD administration on July 15, 2015 and opened talks -- weekly meetings -- with them to resolve the conflict peacefully, the administration still has the legal "right" to complete the eviction process and has refused to ask the trial court to set aside the eviction ruling or, alternatively, has refused to negotiate a legal settlement out of court to resolve our appeal of that ruling. They are hanging on to the chance of winning the appeal. We all have to ask "why?"

 

 

 

 

WHAT IS AT STAKE?

1) If we win then the June 13, 2014 Notice of Termination of the Che Café lease will be nullified;

 

2) If we win then the 2006-2016 Master Space Agreement (MSA) lease will be reinstated;

 

3) If we win then the UCSD administration will be ordered to comply with the dispute resolution procedure contained in the MSA; ironically, the last step in that procedure (Chancellor Review) is similar to what we have been doing with the Che delegation meetings with the Chancellor and his administration since July 15, 2015;

 

4) If we win then the eviction ruling will be overturned and the eviction order posted on the Café in March 2015 will be nullified;

 

5) If we win then the court may order the UC Regents and UCSD administration to pay our legal expenses (over $20K, so far);

 

6) If we lose then it is unlikely that the UCSD administration will immediately change course and stop the positive negotiations we have had since July 2015 -- to resolve the dispute without an eviction confrontation and with the administration agreeing instead to pay for some or all building repairs and maintenance work -- but the administration would be on stronger legal ground if they changed their public position again and decided to push forward with eviction;

 

7) If we lose then both a trial court and an appellate court would have rubber-stamped a "right" of the UCSD administration to ARBITRARILY terminate a student coop lease. The long term ramifications for all four of the current student/worker-owned and operated coops* could include constant risk of eviction and no security of their place on the campus. Whether new protections against arbitrary eviction could be written into a new lease, and hold up in court, would be in question;

 

8) If we lose then we may have to depend even more than we have (which is substantial and impressive already) on direct action and public pressure to not only Save the Che Café, but to Protect All the Coops.

For over 25 years, the San Diego's Peace on Earth Holiday Bazaar has promoted alternative holiday gift giving by offering people the opportunity to purchase violence-free, socially responsible gifts. The event is held annually for local not-for-profit community organizations that are working with nonviolent means and in collaboration for peace, social justice, and an environmentally healthy world.

This year, we will again include elements of entertainment to make the event an enjoyable experience for all who attend. We will be working to draw more sellers and buyers using social media, fliers and other outreach methods. Our committee is working hard each year to make the Holiday Bazaar bigger and better!

DEADLINE >> Early bird is NO LATER THAN Saturday, November 1. The final deadline is November 15. Space is limited and could run out, so PLEASE reply BEFORE THE DEADLINE. An email or phone message will NOT reserve your space – you must submit the application online or by mail as described.

TABLE FEES >> We include two chairs for each group. The fees cover the facility costs, flyers, mailings, tables, chairs and other expenses. After Nov. 1, the fees increase and are $10 per table higher. The final deadline to apply will be Saturday Nov 15th.

** EARLY BIRD Applications BY Nov 1st (11:59 PM) ** have the following choices:
one 6-foot table ($25),
two 6' tables ($50),
or three 6' tables ($75).

** STANDARD Applications completed Nov 2-15 will have choices of:

SELLING ITEMS >> In the past, groups have raised funds at the bazaar with greeting cards, books, t-shirts, CDs, posters, gift memberships, seedlings, handicrafts, baked goods, etc. We believe it is important to keep expanding the selection of items for shoppers, so please consider adding to your offerings this year.

Local Veterans To Honor Fallen Veterans From Southern California On Veterans Day (Wednesday, November 11th)

 

Summary:

 

The San Diego Veterans For Peace chapter will be setting up its Hometown Arlington West Memorial from 8 AM to 5 PM on Veterans Day, November 11th, 2015, in front of the USS Midway Museum on Harbor Drive.  The memorial consists of Arlington Cemetery replica headstones with the name, local city and date of death for the 300+ service members from southern California who have died in the Iraq and Afghanistan wars.  Visitors are encouraged to stop by, honor the fallen, take a turn reading from the list of the 6500 fallen from the entire US, and reflect on the overall cost of war. 

 

Where:  Front lawn area of the USS Midway Museum, 910 N. Harbor Drive, San Diego, CA

 

When:  8 AM to 5 PM on Veterans Day, Wednesday, November 11th, 2015

 

Why:  Originally Armistice Day, recognizing the end of World War 1, Veterans Day has become a day to honor veterans and especially those who have given their lives in the service of their country. 

 

What:  Hometown Arlington West Memorial, as established and set-up by the San Diego Veterans For Peace Chapter #91.

 

Who:  The San Diego Veterans For Peace, the local chapter of the national Veterans For Peace organization, is a 501-C-3 veterans educational organization, with veterans of all five services and associate members, dedicated to educating the public to the overall costs of war.

The San Diego Climate Mobilization Coalition invites you to join us at Al Gore's Global Day for Climate Action!  

 

Saturday November 14th at Noon at the Federal Building on Broadway and Front Street, San Diego 92101. 

 

 In conjunction with Al Gore's Climate Reality Project and leading up to the December Paris talks we will be calling on the U.S. Government to begin the national mobilization to make the transition off fossil fuel and on renewable energy!

 

We encourage organizations to have a contingent present for the rally.  Artistic expression via signs, banners, costumes, street theatre is encouraged.
